Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and TingaTalk ("we," "us," or "our") governing your access to and use of the TingaTalk mobile application (the "App") and the website located at tingatalk.com (the "Website"), collectively referred to as the "Service."

By downloading, installing, registering for, or using TingaTalk, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. We reserve the right to refuse service to anyone for any reason at any time.

2. Eligibility

To use TingaTalk, you must meet the following eligibility requirements:

  • You must be at least 18 years of age. TingaTalk is not intended for use by individuals under the age of 18, and we do not knowingly collect information from minors.
  • You must not be prohibited from using the Service under the laws of the jurisdiction in which you reside or from which you access the Service.
  • You must not have been previously banned, suspended, or removed from TingaTalk for violating these Terms.
  • You must provide accurate, truthful, and complete information during the registration process and keep your account information up to date at all times.

3. Account Registration

To access the features of TingaTalk, you must register for an account. By registering, you agree to the following:

  • Phone verification: Account registration requires verification of your phone number through a one-time password (OTP) sent via SMS. This is mandatory and cannot be bypassed.
  • Account security: You are solely responsible for maintaining the confidentiality and security of your account. You agree to notify us immediately of any unauthorized access to or use of your account.
  • One account per person: Each individual may maintain only one TingaTalk account. Creating multiple accounts is a violation of these Terms and may result in the suspension or termination of all associated accounts.
  • Accurate information: You must provide truthful and accurate information including your real name, age, gender, and a genuine profile photograph. Misrepresentation of your identity is strictly prohibited.

4. The Service

TingaTalk provides a platform for users to connect through video and voice calls. The Service includes, but is not limited to, user profile creation, discovery of other users, voice calling, video calling, a virtual coins system, and related features.

We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time, with or without prior notice. This includes adding or removing features, changing user interface elements, and adjusting the coins system. We will make reasonable efforts to notify users of significant changes.

We do not guarantee that the Service will be available at all times or without interruption. The Service may be subject to scheduled maintenance, unplanned outages, or disruptions caused by factors beyond our control. We shall not be liable for any loss or damage arising from the unavailability of the Service.

5. Virtual Coins System

TingaTalk utilizes a virtual coins system that facilitates interactions on the platform. By using the coins system, you agree to the following terms:

  • No real-world value: Coins are a virtual currency used exclusively within the TingaTalk platform. They have no real-world monetary value, are not a form of currency, and cannot be redeemed for cash except through TingaTalk's designated withdrawal process for eligible earned coins.
  • Non-transferable: Coins cannot be transferred, traded, or gifted between user accounts. Any attempt to transfer coins outside of the platform's intended mechanisms is a violation of these Terms.
  • Pricing: Coin package prices are subject to change at our discretion. We will display the current pricing at the time of purchase, and any changes will apply to future purchases only.
  • No refunds: All coin purchases are final and non-refundable, except where required by applicable law or the policies of the respective app store (Google Play Store or Apple App Store).
  • Withdrawal thresholds: Coins earned through platform activity are subject to minimum withdrawal thresholds. TingaTalk reserves the right to set, modify, or adjust these thresholds at any time. Applicable fees and taxes may be deducted from withdrawal amounts.

6. User Conduct

By using TingaTalk, you agree to conduct yourself in a respectful and lawful manner. The following activities are strictly prohibited and may result in immediate account suspension or termination:

  • Harassment and abuse: Engaging in harassment, bullying, intimidation, threats, hate speech, or any form of abusive behavior directed at other users.
  • Explicit and illegal content: Transmitting, sharing, or displaying obscene, sexually explicit, pornographic, violent, or otherwise illegal content during calls or through profile information.
  • Impersonation: Impersonating another person, creating fake profiles, or misrepresenting your identity, age, gender, or any other personal information.
  • Spam and solicitation: Using the platform for commercial solicitation, advertising, spam, promotion of third-party products or services, or any form of unsolicited messaging.
  • Manipulation: Attempting to manipulate, exploit, or abuse the coins system, including but not limited to using automated tools, creating fake engagement, or colluding with other users to artificially inflate coin earnings.
  • Technical interference: Reverse engineering, decompiling, disassembling, or hacking any part of the Service. Attempting to gain unauthorized access to our servers, databases, or other users' accounts. Introducing malware, viruses, or other harmful code.

7. Content & Intellectual Property

TingaTalk's intellectual property: The TingaTalk name, logo, visual design, source code, algorithms, and all other intellectual property associated with the Service are owned exclusively by TingaTalk and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included intellectual property without our explicit written permission.

User content: You retain ownership of the content you create and share on TingaTalk, including your profile information, photos, and any other materials you upload. However, by using the Service, you grant TingaTalk a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service.

Third-party rights: You must not upload, share, or display content that infringes upon the intellectual property rights of any third party. If we receive a valid complaint regarding copyright or trademark infringement, we may remove the offending content and take appropriate action against the responsible user, including account termination.

8. Payments & Refunds

All purchases made within TingaTalk are processed through third-party payment platforms:

  • Android users: Payments are processed through Razorpay or Google Play Billing. Transactions are subject to Google Play's terms of service and refund policies.
  • iOS users: In-app purchases are processed through Apple's App Store payment system. Transactions are subject to Apple's terms and refund policies.

TingaTalk is not responsible for payment processing errors, failures, or delays caused by third-party payment providers. If you experience an issue with a payment, please first contact the respective app store. For unresolved issues, you may contact our support team at support@tingatalk.com.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TINGATALK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free.
  • Any warranty regarding the accuracy, reliability, or completeness of any content or information provided through the Service.
  • Any warranty regarding the quality of connections, the behavior of other users, or the outcome of any interaction facilitated through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TINGATALK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or goodwill
  • Personal injury or emotional distress
  • Unauthorized access to or alteration of your data
  • Conduct or content of any third party on the Service
  • Any interactions or disputes between users

In no event shall TingaTalk's total aggregate liability to you for all claims arising out of or relating to the Service exceed the amount you have paid to TingaTalk in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred Indian Rupees (INR 100), whichever is greater.

TingaTalk is not liable for any actions, behavior, or conduct of users on the platform. Interactions between users are at your own risk, and we strongly encourage you to exercise caution and good judgment when communicating with other users.

11. Indemnification

You agree to indemnify, defend, and hold harmless TingaTalk, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any content you submit, post, or transmit through the Service; or (e) your negligent or wrongful conduct. This indemnification obligation shall survive the termination of your account and these Terms.

12. Termination

We reserve the right to suspend, restrict, or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or our community guidelines
  • Engaging in fraudulent or illegal activity
  • Receiving multiple user reports for inappropriate behavior
  • Creating risk or legal exposure for TingaTalk
  • Extended periods of account inactivity

You may delete your account at any time through Profile > Settings > Delete Account, or by contacting our support team. Account deletion is permanent and cannot be undone.

Upon termination or deletion of your account, whether initiated by you or by TingaTalk, any unused coins remaining in your account may be forfeited. You will not be entitled to a refund for any previously purchased coins, except where required by applicable law. Provisions of these Terms that by their nature should survive termination will remain in effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes, controversies, or claims arising out of or relating to these Terms, the Service, or your use thereof shall be subject to the exclusive jurisdiction of the competent courts located in India.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will provide reasonable notice by:

  • Posting the updated Terms on our Website with a revised effective date
  • Sending a push notification or in-app notice for significant changes
  • Requiring acceptance of updated Terms upon your next login if the changes are substantial

Your continued use of the Service after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.
